A WIPO provisional refusal in Sweden is a Swedish national office action concerning the effect of an international trademark registration. The Swedish Intellectual Property Office (PRV) examines the designation and issues the underlying order or opposition notice; WIPO transmits and records the communication under the Madrid System.

Distinguish ex-officio refusal from opposition
An ex-officio refusal arises from PRV’s own examination of the designation. An opposition-based refusal arises because a third party has challenged the Swedish effect of the international registration. The distinction affects the response, evidence and deadline.
WIPO’s current member table lists three months from the date PRV issues an ex-officio provisional refusal and two months from the PRV issue date for a refusal based on opposition. The exact date in the PRV or WIPO notice controls. What PRV examines
PRV checks that the trademark and designation meet Swedish requirements. A refusal may concern formal deficiencies, unclear goods and services, lack of distinctive character, descriptiveness, misleading matter, public policy, or a conflict with an earlier trademark, company name or other right. The order explains why PRV considers registration unavailable for all or part of the claimed scope.
PRV can decide the case in full or in part. If an impediment affects only some goods and services, the unaffected scope may still proceed. This makes it important to map each objection against the specification, rather than treating the notice as a single all-or-nothing issue.
Answering a Swedish distinctiveness or descriptiveness objection
The response should address how the relevant Swedish public will perceive the sign for the goods or services in question. We analyse the words, figurative elements, grammar, conceptual distance and overall impression, then relate those points to Swedish and EU trademark principles where appropriate. The aim is to show why the mark functions as an indicator of commercial origin rather than an ordinary product description.
Where acquired distinctiveness is relevant, the evidence must demonstrate recognition in Sweden. Sales figures, duration and geographic extent of use, Swedish advertising, website analytics, retailer material, media coverage, market surveys and independent trade evidence can all contribute. Each exhibit should be dated and explained so PRV can see its territory, audience and relationship to the mark.
Handling an earlier-right objection
For a cited earlier right, we compare the signs visually, aurally and conceptually, assess the overlap between goods and services, and consider the strength and status of the earlier mark. The response can combine legal argument with a targeted limitation, consent or coexistence discussions where that route fits the owner’s commercial position.

Where the earlier registration is old enough, proof of genuine use may be a central procedural and evidential issue.
Opposition strategy is both legal and commercial. We consider prospects, cost, the value of the Swedish market, potential limitations, settlement language and the effect of any agreement on parallel Nordic or EU rights.
