A WIPO provisional refusal for Denmark is a national Danish office action inside an international trademark registration. The World Intellectual Property Organization transmits the notice because the mark was filed through the Madrid System, but the objection comes from the Danish Patent and Trademark Office (DKPTO) and must be answered in the Danish proceeding.
The word “refusal” sounds final, but the notification normally opens a response stage before DKPTO reaches its final position. Start with the underlying DKPTO notification
The WIPO cover message is only the first layer of the file. The attached DKPTO notification contains the international registration number, the affected goods and services, the legal grounds, the response route and the deadline. It may be a total provisional refusal covering the complete Danish designation or a partial refusal limited to particular terms or classes.

What DKPTO examines in a Madrid designation
An international registration designating Denmark is examined under Danish trademark law. DKPTO checks formal matters, the clarity and precision of the goods and services, and absolute grounds such as whether the sign is distinctive, descriptive, customary, misleading or contrary to public policy. DKPTO also searches for earlier confusingly similar rights and may provide a search report. Under the Danish national system, earlier-right search results are informative; an opposition by a third party is a separate procedure that can also produce a provisional refusal through WIPO.
This distinction is important. A letter citing an absolute ground requires submissions directed to the examiner’s legal assessment. A notification based on an opposition requires a defence against the opponent’s claimed earlier right. A search report may call for commercial risk analysis even where it is not itself the formal reason for refusal.
Response options for a Danish ex-officio refusal
A good response begins with the exact wording of each objection. If DKPTO considers the mark descriptive or non-distinctive, the analysis should address the perception of the relevant Danish public, the ordinary meaning of the sign and its relationship to the goods or services. Evidence of established market recognition may be relevant where the owner has used the mark sufficiently in Denmark.
If the objection concerns the specification, we identify the wording DKPTO considers unclear and prepare a limitation or clarification that remains within the scope of the international registration. The Madrid designation cannot be broadened through the response. A focused limitation can preserve protection for the commercially important goods or services while removing the issue identified by the examiner.

Where several grounds are raised, the response is structured ground by ground so the examiner can see precisely how each point has been answered.
Responding to a Danish opposition notification
An opposition-based provisional refusal means a third party has challenged the effect of the international registration in Denmark. It does not mean that the opponent has already won. We review the earlier right, priority, ownership, similarity of the signs, overlap between the goods and services and any use-related issues available under Danish procedure.
The response strategy may include legal submissions, a request for relevant proof, a negotiated coexistence or consent arrangement, or a limitation that removes the commercial overlap.
