Patent annuities in Sweden: keeping patent rights in force

Swedish patent annuities maintain national applications, granted patents and European patents validated in Sweden. PRV’s schedule begins in the third fee year and increases through the patent term. Each annual decision should therefore be based on the right’s current status, fee year, commercial value and exact official deadline.

The Swedish fee year

PRV states that the first two years after filing do not carry separate fee amounts and that the first annual fee is due when the application enters its third year. The fee year begins on the day after the filing anniversary. The annual fee must reach PRV by the due date, which the office describes as the last day of the first month of that fee year.

The calculation is tied to the filing date, not to the grant certificate or the date an agent first sent a reminder. NordicIP records the original filing history and fee year so a change of status from application to granted patent does not break the renewal sequence.

Regular and increased fees

PRV publishes a regular and increased amount for each annual fee. Its current table starts at SEK 1,600 for the third annual fee and rises through the later years. The increased amount is 20% above the regular fee.

If the normal deadline is missed, PRV provides six months in which the annual fee can be paid with that increase. A client-facing quote should identify whether it is based on the regular or late period and the exact date on which the late route ends.

Payment begins before grant in many cases

Annual fees are required while a Swedish national application is pending. The owner should not wait for grant before establishing the docket. The first payment decision may therefore arrive while examination continues, and non-payment can affect the pending application as well as a granted right.

NordicIP checks pending status and any recent PRV communication when setting up the case. If the public data and the inherited docket disagree, the discrepancy is reported before an instruction is requested.

PRV does not send an invoice

PRV’s guidance states that the owner must remember the correct deadline and amount because the office does not issue an invoice. A reliable portfolio process should use its own diary and escalation rules. Office notices can support the record, but they should not be the event that creates it.

Ownership and record checks

The entity giving instructions should match the proprietor or be authorised by it. A merger, assignment or change of name may need separate recordal work. Payment and recordal can often be planned together, but they are distinct actions. The annuity deadline should remain protected while the supporting ownership documentation is organised.
